By Rehanna RamsayAttorneys-at-law Peter Hugh and Latchmie Rahamat have filed a constitutional motion in the High Court seeking redress for murder accused, Mark Thompson.Thompson, of Awarewaunu Village, South Rupununi, was incarcerated some five years ago for the murder of Brazilian miner, Jose Rodriguez De Oliveira.It was reported that on August 7, 2010 at Aranka Backdam, Cuyuni River, Region Seven, Thompson chopped De Oliveira to death during a heated argument. The accused and the victim had allegedly been consuming alcohol, at the time.Hours after the incident, Thompson was arrested by police and taken into custody.According to court documents, Thompson was charged for the murder and underwent a preliminary inquiry at the Bartica Magistrate’s Court, which lasted for approximately 2 years and 10 months.Magistrate Faith Mc Gusty presided over the PI. She subsequently committed the accused to stand trial at the Essequibo Assizes at the High Court of the Supreme Court of Judicature.But until now, the matter is on the list of criminal trials to be heard.  It is upon these facts that Thompson’s Attorneys premised their application to have a High Court order to stay any further prosecution of the criminal charges against him.They are claiming  that  their client’s constitutional  rights  to due  process  and the protection of the law have been and continues to be infringed by the Judicial Arm of the State  for which,   he is entitled to constitutional  redress.The lawyers are seeking a declaration by the court that Thompson’s fundamental rights to hearing within a reasonable time guaranteed under article 144 (1) of the constitution is likely to be further infringed, if the criminal charge filed against him is not stayed.Additionally, the attorneys want the Court to grant an order that the applicant (Thompson) be granted bail and released upon reasonable conditions pending the completion of the trial should the court be not inclined to grant the order to stay the charge.Their request further is that the court make such orders or summons a directive, as it considers  appropriate in the circumstances,   concerning  breaches  of  Thompson’s fundamental  rights to damages  and/or aggravated  damages and compensation, Jerseys NFL Cheap, or other forms of relief as the court deems just.According to a motion filed on July 18, 2015, Thompson’s dilemma is that he has been languishing behind bars for the past 4 and 10 months without any knowledge of when the charge which was instituted against him will be heard in a trial.However, the attorneys expounded that under article 144 of the Constitution of the Co-operative Republic of Guyana, their client is entitled to a fair hearing of the criminalcharges laid against him within a reasonable time in an independent and impartial court.“(But) there is an abuse of process on the part of the Judicial Arm of the State, which has resulted in breaches of Thompson constitutional right to a fair hearing within a reasonable time, ” the attorneys said.They outlined that the undue and unreasonable delay has resulted in the accused losing contact with witnesses that are supposed to testify in the matter, in his defence, at the High Court trial.According to the document, the applicant claims that the witnesses might have relocated and since he has been on remand for the past 4 years, he is unable to say where they went or where they can be found at this point in time.“For the State to be allowed to continue the prosecution of the matter against the applicant will be nothing more than an abuse of process and flagrant disregard of the applicant’s constitutional right to a fair hearing within a reasonable time, ” the court document related.The applicant is therefore seeking an order to stay any further prosecution of the criminal charge filed against him on grounds that the undue and unreasonable delay by the State to complete the matter is no fault of the applicant, and has operated to the detriment of his defence, because after approximately, 4 years and 10 months later his witnesses are no longer available.

Government is fast-tracking plans to ease the traffic nightmare at several busy intersections along the East Bank of Demerara.The Ministry of Public Infrastructure earlier this year had revealed plans to construct a vehicle and pedestrian overhead crossings at several areas including the Diamond intersection.Projects Manager of the Ministry, Deion Sanders Falcons Jersey, Sunil Ganesh, had disclosed last October that the tenders for the project would be advertised shortly and works are pegged to commence early next year.“There are about 20, 000 vehicles that use that intersection, so this vehicle overhead pass would significantly reduce the backup of traffic existing in Diamond, so when the vehicle overhead pass is completed you have free flow of traffic coming out of Diamond, there will be almost zero delay, ” Ganesh had explained.In addition to the vehicular overhead pass at Diamond, pedestrian overhead passes would be constructed at the Harbour Bridge next to the office of the Neighbourhood Democratic Council, another at Eccles on the eastern side of the traffic light and a third in the vicinity of the Houston Secondary School.Yesterday, it was revealed that one company – RM Engineering Limited out of Trinidad and Tobago, submitted a financial proposal to the National Procurement and Tender Administration Board (NPTAB), for the Supervision Services for the construction of these structures.Linden to Kwakwani Road Corridor The development of the Linden-Ituni-Kwakwani road is part of a plan to stimulate development in Region Ten. The enhancement of these road networks is vital to the creation of jobs, and the possibility of improving commercial activities, a Senior official of the Regional Democratic Council had stated earlier this year.The project was included into the Region’s five-year “action plan”.Numerous complaints were lodged over the past months by drivers also, who stated that they are required to spend more monies to repair their vehicles.“You do not even have jobs (in the region) but you have a case of the drivers spending more money to repair their cars, service their cars, ” a driver stated.Financial proposals were submitted yesterday for the consultancy of a Feasibility Study and Design for the Linden to Kwakwani Road Corridor in Region 10 (Upper Demerara/Upper Berbice). The Ministry of Public Infrastructure was listed as the procuring entity.Reconstruction of St. Rose’s High SchoolTenders were open for Design and Supervision Services for the reconstruction of the St. Rose’s High School, Georgetown. The procuring entity was listed as the Ministry of Education.Rehabilitation of Christiansburg – Wismar Secondary School Tenders were open for Design and Supervision Services for the rehabilitation of the Christiansburg – Wismar Secondary School in Region 10.The procuring entity was listed as the Ministry of Education.Bids were also submitted for the provision of security services for the Ministry of Indigenous People’s Affairs.

The Marketing Director of Guyana Sugar Corporation (GuySuCo), who recently tendered her resignation, will be allowed to function as a consultant should she choose to accept the position.This is according to a well placed source within the hierarchy of the industry who also stated that the former director, Nisa Surujbally, had signalled her intention to resign months ago.Surujbally had wanted to be relieved of her duties for personal issues, her letter of resignation had said.This newspaper has learnt from a source within the Ministry of Agriculture that because of her skills and experience, the Minister is keen on accepting her for a position as a consultant to assist with GuySuCo’s marketing, especially in light of the company’s turnaround plan.Her replacement, Raj Singh, himself a former board member, will be tasked with marketing and pushing agriculture aspects of the company, Kaieteur News was told.He will be installed as a Deputy Chief Executive and will play a critical role in the turnaround plan for the sugar industry which is currently facing several uphill battles.It was reported that Surujbally, who is wife of Dr Steve Surujbally, Chairman of the Guyana Elections Commission, resigned after she was reportedly locked out of a top management meeting almost two weeks ago. She reportedly tendered her resignation the same day.According to the source, however, to lock someone of the calibre of Surujbally out of the meeting for being a few minutes late is a “stupid, childish excuse” that is “ludicrous.
